The focus of our practice is on civil and criminal tax controiversies in Connecticut and New York City.  An individual’s petition to invalidate four Notices of Federal Tax Liens filed against him was dismissed for failure to state a claim on which relief could be granted. He petitioned the court to invalidate the liens based on a number of tax-protestor-type arguments including, inter alia, that there was no authority for filing the Notices against him under the Administrative Procedures Act, that no Executive Orders existed to establish internal revenue districts for the collection and enforcement of income taxes, the regulations used by the IRS for its assessment authority and its method of assessment were unenforceable because they aren’t published in the Federal Register, and the au...

The number one reason why business owners in New Haven, Connecticut come to us for IRS help is payroll tax debts. Unpaid payroll taxes can wreak financial havoc for both the business and the individual owners. When a business fails to pay over its payroll taxes to the IRS the agency can assess those responsible individuals for the “Trust Fund” portion of the taxes, meaning those taxes actually withheld from the employees pay.A recent opinion from the United States Tax Court provides some great insight into who can be considered a “responsible person” in the context of an assessment of trust fund recovery penalties (“TFRP”). In Fitzpatrick v. Commissioner of Internal Revenue, T.C. Memo. 2016-199 (Nov. 2, 2016), Judge Vasquez held that an individual was not liable for the TFRP assessed ag...

Attorney Eric Green from the Connecticut Tax Boutique Law Firm Green & Sklarz LLC was asked to make comments on the record for the Internal Revenue Service's (IRS) National Taxpayer Advocate in Washington, DC.  The Forum with Nina Olson, the National Taxpayer Advocate, was recorded, and the recording has been made public. You can watch Attorney Green's comments HEREDuring his comments Attorney Green commented on the issues he sees currently with the IRS, including its Offer-in-Compromise program, its implementation of the Fixing America's Surface Transportation Act  ("FAST Act"), which ridiculously has 25 pages that impact IRS Collection which Congress buried in the Act.  The Act now requires the IRS to use private debt collectors and to transfer over to the State Department those taxpa...

It is not infrequent that companies that have cash-slow issues fall beind in their payroll tax payments to the Internal Revenue Service (IRS).  In fact, it might be the number one reason why taxpayers who need help with the IRS end up coming to us.  Now for years, as we have helped taxpayers in New Haven, Connecticut and beyond with payroll tax liabilities.  Things appear to be changing in this area of IRS enforcement. In 1998 Congress changed the statute to require the IRS to provide a taxpayer an opportunity for a Collection Due Process (CDP) hearing with an IRS Appeals Officer (referred to as "Settlement Officers") prior to proceeding to levy action.  In 2007 Congress amended the statute to allow the IRS to proceed directly to levy without notice if the taxpayer had already had a CDP ...

We focus on tax related issues, including civil and criminal tax controversies in New Haven and across Connecticut and New York.  At the latest American Bar Association Tax Section Meeting Acting Assistant Attorney General Caroline Ciraolo confirmed that the Department of Justice Tax Division and IRS Criminal Investigation will continue their combined crackdown on businesses and business owners who fail to properly account for and pay-over payroll tax dollars.  The message was as strong as that delivered last November at the New England IRS Representation Conference at Foxwoods Hotel & Casino by Ciraolo.  You can watch my interview of Caroline Ciraolo here (the video at the bottom named “Eric Green’s Interview of Carline Ciraolo, Acting Assistant Attorney General for The Dept. of Justic...

Things To Do in New Haven-Movie Theaters   Whether you're directly in downtown New Haven or in the surrounding areas you'll find a great array of movie theaters to go to.  It doesn't matter if it's winter, spring, summer or fall,  the movie theater is always a popular place  if you're local or just happen to be visiting the area.     Nothing beats viewing the newest flicks on the mega screen while being surrounded by the delightful aroma of a fresh box of popcorn and a cold drink. A little trivia tidbit about theaters in New Haven.  One of the first movie theaters was the Roger Sherman Theater built in 1926 on the property of the Rialto move theater which was destroyed by a fire  years earlier in 1921.  It later became the Palace Theater in 1984 until that closed in 2002.  Construction ...
