Website:  vonweisslaw.com What do I get if my spouse dies without a Will?   A preliminary issue is whether there is a valid and enforceable prenuptial agreement or separation agreement impacting the inheritance rights of the surviving spouse.  The balance of this blog assumes there is no such valid and enforceable prenuptial or separation agreement.  The Massachusetts Uniform Probate Code (MUPC) became effective as of March 31, 2012.   In the absence of a Will, § 2-102 of the MUPC provides that the surviving spouse is entitled to the entire estate in two circumstances.  The first circumstance is where there are no stepchildren or descendants of stepchildren, i.e., all...

Abington, Massachusetts is a small bedroom community. The town was famous as part of the shoe industry and, as recently as 1986, had a working dairy farm. Today, though the town's roots in manufacturing and agriculture have given way to a primarily residential community character, several small and medium size businesses flourish within the boundaries of the quiet town. The town was founded in 1712 and although it has experienced substantial growth over the last several decades, the community retains a great deal of open space and a rural feeling. Residents are proud of the parks and recreation facilities, including Island Grove Pond and Park, The Dyer Museum, and Ames Nowell State Park. In addition, the growth of the town has not diminished the local spirit. There are several active ci...
