Often times when a Real Estate market heads south it is normally because of a much needed correction from escalated appreciations.  When supply is low and demand is high, Property sellers are able to mark up the property price well above 16% of the normal median.  In Boise, Idaho we had a 4% jump in Price Growth from 2003 to 2004 and a 16% jump from 2004 to 2005. 2006 was the start of our correction falling 6% from 2005. Our first quarter's statistics show our market falling an additional 6% from 2006 and another 8% for the second quarter. The current 30 year fixed mortgage rate is at a shocking 6.74%, which is putting a damper on even the most qualified borrowers.  As subprime borrowers deal with stronger standards, the epidemic of rising mortgage rates is only pushing subprime borrowers further and further away from the home owning and property flipping dream.  Please tell me what you think? Imagine you are living in a condominium or townhome and you have smokers living around you and the smoke is such a bother and you fear future health risks to you and/or your children.  You could take matters to court and opt to legally amend your decoration and put a ban on smoking in the entire building or living areas.
