Friday Flags: The Prospect CT Green with No One AroundThe center of Prospect CT is a 4-way intersection of state roads. As one takes the tun to drive down RT 68, one can see the Prospect town green, or more specifically the flagpole. As I went down, I caught the flag fluttering in the wind, and I took a detour to see if I could get a good shot.I caught one with the Veteran's Memeorial in the background.   I felt that If I waited just a bit longer, I could get a better one, and was rewarded.A crisp breeze, a blue sky for a background and a proud flag to share. We are a great Nation and yet so many take far too much for granted and have little consideration or knowledge of how we got to this reality.Friday Flags: The Prospect CT Green with No One Around

No One Works for Free and That Includes Real EstateThere are some changes coming in the real estate business and if they are handled correctly, they will have minimum impact, at least here in Connecticut. The issue falls to how real estate agents are paid for their efforts, and where their pay comes from. It should first be understood that each real estate agent is a self-employed person with the only connection to a business coming from a mandate that they place their license under a managing brokerage. The cost to being an agent, at the very least are membership to the State Association of Realtors, and then the National Association, local realty boards, which means cost of having access to the MLS System. No one works in this business for an hourly wage with paid medical, retirement, pa...

Uncharacteristic Nighttime Lights in CT This past week has been unusual with weather for many parts of the world. Scientists were warning of strong solar storms that would create issues on our planet, some of which could not be controlled. In the Midwest gps systems that farmers needed for spring planting were affected as the flares that hit us were largely geomagnetic.  There were concerns with communications being disrupted as well as power grids.Something that was seen as a once in a lifetime bonus were the possibilities of nighttime lighting displays not common so far south. There were enough news stories letting people know that lights could be seen at night. It would be necessary to get to a high enough elevation and hopefully get very little interference from residential lighting....

Blooms A Poppin' in Prospect CT 5We have had some warm weather this past week here in Prospect CT, and more of the colors are showing up to be appreciated. The phlox is fully blooming and starting to spread.  I will need to trim it back a bit.Right behind the rock garden and to hide a rock that was too hard to remove is a pink weigela shrub, which seems to get larger blossoms each year. Up closer to the house are the azaleas which are all strutting their colors to be appreciated.Along the driveway the day lilies are not yet to be appreciated, but at the bottom the bleeding hearts are showing their different shades and colors. As I walk around the yard I do not see many beds where colors are ready to emerge, so I will just need to appreciate the flowers for whatever time they have left.Blo...

Blooms A Poppin' in Prospect CT  4We are almost completely there with the spring blooms in Prospect.  The daffodils have just about run their course although there are some hanging on.The phlox at the bottom of the yard that we call the rock garden is in bloom with a carpet of pink. The stragglers of daffodils add some tall color and one can see the choke cherry just behind them all starting it's pink covering of flowers.Closer to the house, the white azalea bushes are showing their colors, and the daffodils are just about done here. The pink azaleas are asking for attention and the reds are just chillin' for their burst of color. It is time for the flower beds to receive their mulch coating so all will look nice and fresh for the summer.Blooms A Poppin' in Prospect CT  4

Friday Flags in Cheshire CT 5.03My good fortune with finding opportunities to share flags continues this week with a flag that stands in front of the Cheshire Volunteer Fire dept at its station near the intersection of Waterbury, Wolcott and Cheshire. With a little patience and a silent prayer to the wind gods, I was rewarded with a flurry of wind and a billowing flag.In a time when so much is taken for granted or even as due, recognizing the flag and the freedoms gotten by so many around the world is something we should not take for granted.Friday Flags in Cheshire CT 5.03

Blooms A Poppin' in Prospect CT,  3Early Sunday afternoon of last week, I was driving into Prospect and as I passed the Medical office building, I was taken enough with the view to turn around and appreciate the almost barren lot.In another few weeks, it will not be as impressive a view even though the trees will be all fully loaded with leaves. The landscaping is very well groomed. On this day the parking lot of adorned with blossoms on the trees as well as azaleas in blossom. When loaded with cars and leaves on the trees it may not even get a second glance as people hustle into the building for appointments. The ground will have a white coating for a while and then all the colors will blend, but on this afternoon, I at least was taken with the colors.Blooms A Poppin' in Prospect CT,  3

It happens all the time - I literally just woke up to it again.  A Press Release from the Department of Justice Tax Division:Maryland Payroll Company Owner Pleads Guilty to Employment Tax Crimes and Embezzling from Employees’ 401(k) PlansSo what happens when a payroll company steals the payroll tax dollars meant for the government?  The employer still owes those payroll tax dollars to the IRS.  The fact that it was stolen by a third party does not relieve the employer of the payroll tax liability.True, we may be able to get penalty abatement due to the bad actor, but the taxes and interest will still be owed to the IRS.This is why I recommend using one of the big national payroll tax companies.  They are all publicly held behemoths that have more than enough resources to correct for any...

Friday Flags in Cheshire CT 4.26I had to take a run to an appointment in Cheshire CT and passed an office structure with a large flagpole out front. I pulled into the parking lot and waited a bit to see if the wind would cooperate, and my pause was rewarded. The wind pushed that flag out and it gave me the opportunity to take the shot I wanted so I could continue my streak for this post.Friday Flags in Cheshire CT 4.26

Recently, the IRS and United States Department of Justice (“DOJ”) have been criminally prosecuting more payroll tax cases than ever before.  Several years ago the decision was made to focus on payroll tax cases for both civil and criminal enforcement, given the importance of payroll taxes to the federal income stream. When it comes to charging taxpayers criminally for the failure to account and pay over payroll taxes there are three main statutes the IRS and DOJ use: IRC § 7202 (the felony statute for payroll tax violations), IRC § 7215 (the misdemeanor statute for payroll violations) and IRC § 7201 (Tax Evasion).IRC § 7202 - Willful Failure to Collect or Pay Over TaxIRC § 7202 makes the failure of an employer to account and pay over the payroll taxes a felony.  IRC § 7202 was designed p...

Businesses that fall behind with payroll taxes are the number one source of new clients for most tax rep professionals.  The IRS takes payroll tax debts very seriously, as it is a double whammy on the government: it does not receive the tax money, and yet it will be issuing refunds to the taxpaying employees when they file their 1040 tax returns. So the IRS has a letter it sends to employers, Letter 903, that outlines the number of enforcement actions that may occur if the employer does not change course and pay the taxes.  These include any and all of the following: File a Notice of Federal Tax Lien (NFTL) to protect the government’s interest. By filing this notice, we are making a legal claim to your property as security for the payment of your tax debt. An NFTL is a public notice to y...

Businesses that fall behind with payroll taxes are the number one source of new clients for most tax rep professionals.  The major issue many of these clients has is confusion about what to do first.  Often we hear “I should make a payment against the oldest period first, that way the IRS knows we are serious.”No they don’t!The IRS does not think that way.  The first step to do anything with the IRS is to get into tax compliance first. What is “Tax Compliance”?In order for the business to have any chance of surviving the tax debt issue is being able to get back into tax compliance, meaning it is filing and paying the payroll taxes on time.  If the business is unable to do this, then it needs to shut down, or the IRS will force the issue by levying the bank accounts and effectively making...

Businesses that fall behind with payroll taxes are the number one source of new clients for most tax rep professionals.  The first three issues that must be dealt with are: Can the business get into and maintain tax compliance? Is this business viable in its current form? If the business is not viable in its current form, can it be restructured to be a viable ongoing concern? Tax ComplianceIn order for the business to have any chance of surviving the tax debt issue is being able to get back into tax compliance, meaning it is filing and paying the payroll taxes on time.  If the business is unable to do this, then it needs to shut down, or the IRS will force the issue by levying the bank accounts and effectively making it impossible to operate.  The reason is that, if the business is not ...

Blooms A Poppin in Prospect CT, 2Our weather was slightly stalled this week as we had cooler temps and a bit of rain. The spring colors may have been slowed, but they still showed additional presence. The pink weeping willow is showing its colors well and is beautiful when they flow with the wind. The rock garden at the bottom of the driveway is coming to life and the daffodils have blossomed and greet all that drive by.The phlox in front of it is starting to show signs of spring and that white/pink carpet should be in full blossom shorty. It's still too early for the azaleas and the pink of the choke cherries will show itself shortly as well. It's spring in the northeast and much appreciated as well.Blooms A Poppin in Prospect CT, 2

We frequently have taxpayers arrive in our office with collection notices for an IRS balance due that they believe they do not owe.  Whether due to not receiving the notice of proposed changes (CP-2000), or because they submitted records that were ignored by the IRS, these taxpayers are now facing balances with penalty and interest they should not have to pay.More often than not it is the Final Notice of Intent to Levy and Your Right to a Hearing (CP-90) that gets them to act and contact us.  Other times it is the Notice of Federal Tax Lien being filed that triggers the response. In either case, the first move is always to request the Collection Due Process hearing (“CDP”) and prepare for the hearing.  This will prevent any levy from being issued and allow us to work out a collection al...

Friday Flags in Cheshire CTThe flag today comes from a plot of ground in front of a colonial structure that was once a thriving business.  Now called the Ball & Socket arts building, it offers attractions and areas to exhibit for local artists. In its heyday, it was a stamping plant that made all manner of buttons, some of which adorned the military uniforms during the Civil War.Back in the late 1980's the company was bought by Waterbury Companies and their museum was merged with that plants.A factory with a proud heritage and once the source of work for so many now has a different audience, but the flag still waves proudly.Friday Flags in Cheshire CT
