 If you are the Administrator of an East Palo Alto Probate Estate that has rental property to sell you need to be aware of the portion of the East Palo Alto Rent Control law that pertains to Just Cause Eviction. You need to know the rules in order to make sure the property is sold without breaking any laws. East Palo Alto has both RENT CONTROL and JUST CAUSE EVICTION Just Cause Eviction means that tenants cannot be asked to vacate just because the lease is up or they are on a month to month rental and you give 30 or 60 days notice (if they have been there a year or more).   A few months ago I was contacted by an administer of a probate estate in East Palo Alto. He wanted to sell his mother's home but was in a quandary. His mother had died last year and all her belongings were in the house. His sister was still living in the East Palo Alto probate home and she was a hoarder. The home was a mess and his ill sister did not want to move out until the house was sold.  Since all the heirs have to agree to the sale, and his sister was hard to convince to co -operate, he did not know how to get the house sold so they could close this East Palo Alto probate. My husband and I went to Home Depot in East Palo Alto this afternoon.  It's not my favorite place, but since it was Father's Day I went with him.  I know he likes company on shopping trips.  I like to shop alone unless I can shop with my sister.  She and I have a rhythm for looking and we, of course, often reach for the same thing.  We  are in sync! When a home is sold through the probate system sometimes court confirmation is required, and sometimes it may not be required. The operative word here is MAY. What this means is that under the Independent Administration of Estates Act, the person in charge of settling the deceased's estate, the Personal Representative, can ask the court if he/she can have the authority to sell a property without court confirmation. Court confirmation happens when an offer is accepted by the Personal Representative and then has to go to the probate court to be approved. I have a new listing coming on the market in East Palo Alto that is being sold through Probate. The seller has passed and the home must be sold to settle the estate. Like many homes in probate, this East Palo Alto Probate is filled with personal belongings that need to be disposed. The owners are at a loss, so they hired me, because I specialize in dealing with selling San Mateo County homes in probate and can help them deal with the mounds of personal property. In East Palo Alto  from Jan 1, 2012 until June 30, 2012 there were: 36 closed short sales 20 closed bank owned homes Total sales during this time period were 96 Total % Short Sales: 37.5% Total % REO Sales: 20.8 % Total Percentage  East Palo Alto Distressed Properties: 60.7% 60.7% of all East Palo Alto sales being distressed is enough to still have major effect on the overall market. However, as inventory is still so low unless these homes are truly physically distressed, which is more common with bank owned homes at this level, it probably will not have a long lived effect.     There is another conflict brewing between investors and first time home-buyers, and this time the home buyers may win. In the more affordable areas of the Silicon Valley distressed properties, ie short sales and reos have been popular with investors and first time buyers. Many would be owner occupiers lose out on great opportunities to investors who have all cash.  Since condos are the least expensive properties, have the fewest maintenance issue,  and tend to bring in more rent per dollar spent they are popular with investors.
