More ambulance chasing if you ask me. Our contracts allow for people to purchase without having their identity reported to a seller. There's nothing illegal about that. 

Kat Palmiotti makes an interesting point. Now, let's turn that around... what if buyers were suing over the fact that a seller made too much money on the sale of a house based on what they paid for a house.

Fred Griffin Florida Real Estate - If the brokerage was acting as a transaction broker in Florida I don't believe they have a duty to disclose. More facts necessary. Did Bezos say this is my best and highest offer? Did Bezos tell the brokerage not to disclose him as the buyer? Did the agent twist the seller's arm or just disclose the situation as he found it?

Think the seller is fishing for a settlement. A long shot in court and likely, with the laws in Florida, that an astute attorney will get the case dismissed and ask the seller to pay attorney fees of the brokerage.

Seller loses. I have not seen the contract but a buyer can call the buyer an entity. If seller needed to know who owned the entity on day one they could have countered, but they didn't. It's luxury so seller can assume someone with a pile of money is going to purchase. Seller took the best offer available that day.

This is meaty! LOL so 'what's confidential' is the question. What is required to be disclosed. Who represents who? Was there a way for the seller to find out who the likely buyer was? His spidey senses should have been tingling knowing what he knew in that tiny part of town. Did he ask his agents to ascertain the buyer's identity before he would sign the deal? Why didn't the seller just negotiate a better price or hold firm on his asking?

Doesn't Florida have transaction brokerage to where the agents don't represent anybody but the deal? I don't see in this article where there was exclusive representation of only the seller. So a lot would depend on who represents who.

IF the brokers denied the identity of the buyer when the seller suspected it, knowing he was right . . . I suspect there will be a settlement and the real estate brokers will cough up some dough to make it go away.

Interesting. So if a person were to buy a home for, lets say, $500K, but their financials/bank account/mortgage approval shows they could have paid more, say the $550K asking price, then there could be a lawsuit to recover the "missing" money? This lawsuit makes no sense to me.

Ultimately, the identity of the buyer isn't the key issue, as long as the transaction is legal. The real question is whether the listing agent was aware of the buyer’s identity and concealed it, or if Jeff employed a common celebrity strategy by using a third party to avoid inflating the price due to his status. This sounds like a seller that wanted to fleece Bezos and is pissed he didn't. Not that I care about Bezos, but I do care about proper procedure and ethics.

If this Agent was the Listing Agent , they had the Obligation to give their Client Full Disclosure under the Legal Precept of Imputed Knowledge.

This is another reason that Dual Agency should be eliminated as a result of the NAR Defeat !

So sad everyone now wants to file a suit for whatever reason!   Buyers can withhold their name here in Colorado, but if the Listing agent knows who it is, and has a buyer agency, this may be an issue.   The Seller did not have to reduce the price, could have waited until they got a "better buyer".

One could only hope with all this BS going on that the Broker being sued has some Remedy as to maybe suing back and collecting three-times the amount suing for. Maybe that would help stop some of this BS going on!!!

Too much missing information to even give a reasonable guess.  Was the seller harmed? Why was the information withheld.  We there collusion?  Many more missing details.

The Douglas Elliman agency was both listing and seller broker.

The seller supposedly asked their brokerage if Bezos, who had recently bought the house next door, was the buyer. The seller was told that Bezos was not the buyer. The seller sold at a $6 million discount from asking price and is suing for that amount. Why? He could have countered the offer and gotten full price or more, perhaps.

It will be interesting to see what the court decides...unless a settlement is made and kept confidential
