#1 CA is not affected by this lawsuit due to our CAR forms.
#2 We're years away from results due to the court of appeals.
#3 This was a frivolous lawsuit in principle since all commissions are always negotiable. So unless someone screwed the pooch in Missouri, there's many a slip twixt a cup and a lip.

When you hire me you choose from a 7%-6%-5% rate sheet and the menu of services that correlates accordingly.

In Oregon we are trying to make buyer contracts mandatory per state law. This will enable buyer's agents to negotiate directly with their buyers on their fee - and to demonstrate their worth.

I thank God that I am retired Richie Alan Naggar but then again I used to have both sides more often then not being the Broker for the developers, Builders, and Contractors and it usually ended up being 3-4% so it would not be a change for me if I were active. I imagine many Brokers who represented a clientele like mine may just go to a salary.

The operative word here is "may" bring changes.  I have not invested much if any, energy or thought into what "may" happen.  I am aware of the lawsuits and drama taking place. 

 

As a listing agent, my fees will always be my fees. I do not "compete" with how low will you go.  I raise the bar, not lower it.  

 

I do not expect much to change. Many things happen in life that I do not expect, yet when the unexpected happens, I deal with them. 

 

If/when the time comes, I will consult with my attorney about the best way to structure, including addendums if necessary, to ensure my proverbial backside, and that of my clients, are covered.

Like Bob "RealMan" Timm I am retired, parked and reading. They have been trying through threatened litigation and actual litigation to attack commissions for years. Change will come as it always does but not until long after I grace the other side of the grass. No worries, be happy!

I will also not discuss details in a public forum.

While I agree with Thomas J. Nelson, REALTOR ® e-Pro CRS RCS-D Vets, that California's long-standing real estate practices may to protect us from litigation, the cat is out of the bag as far as the general public is concerned. Many will think they will not be entitle and enabled to pay less than in the past for seller and buyer representation. We need to learn to manage this change.

I doubt if we see much change. When sellers start wondering why no one is showing their house, they'll offer reasonable commission. Sellers that continue to offer 4.5-6% will most likely get their homes sold first.

I don't see any significant changes in the way listing Brokers operate.  These suits are all about the money and paying for the lawyer's next vacation home.  I don't see the cooperation model being struck down as illegal.  If anything, more states will need to be like California and have the SOC in the listing agreement.  At the core, these suits are about the seller not knowing.

Some things are finalized here in NYC with changes set to occur for Jan 1, 2024- so only about 6 weeks away.  While I mentioned this in a couple of places in Active rain previously- there is a new commissions lawsuit that just occurred focusing on our trade organization, REBNY, which is a substitute for NAR. We also don't have an MLS.  REBNY focused on a policy that was based on a model of fairness- i.e. equal payment to both buyer and seller brokers at a minimum - though a higher buyer agent payment could be established. There is also an option for the seller to pay a lesser payment to a buyer's agent or no payment if requested.  I don't want to comment beyond what is available publicly as my firm and 25 other NYC brokerages were also named in this suit.
