Not all "new" is new!  It totally depends on what you're bringing to the party.  I think our pre licensing education is a bit more extensive than our Southern neighbours and we are quite prepared to handle our first transactions.  I remember telling my first clients that they'd not find someone more up to date on all the new regulations and guidelines lol and that no one would have more time and energy to work exclusively for them.

First Q.  Only if they ask. My first client (buyer) did not know I was new. When he later found out he said he thought I had been in the business for years. I've completed 4 transactions with him in 19 years.

Second Q. No. Unless they were asked and lied. 

Third Q.  Toooooo many people, in my opinion.

Here in NH they do not have t disclose it unless asked. I think it certainly makes a difference and should be one of the first few questions by any seller.

It is not a violation of their fiduciary.  A new agent should sell their strengths - they have more energy, more time, or more drive than that relic in the office who just rests on his laurels.  

People hire inexperienced people all the time.  Didn't you have a first job at some point?  We routinely elect people who don't have experience.  Usually their pitch is that they have fresh ideas and not the old relic in the office who is resting on their laurels.  Same with new agents - play to your strengths.

I always was upfront about my being new in the business but showed my experience selling in the automobile industry, which generally earned their business.

Other than that it is up to each individual.

We go through a fair amount of training before we hit the streets.  Some of us more than others, and some of us absorb that training better than others.  Many are incredibly talented out of the box, yet I could point to multitudes who've been doing this for ages who can't "real-estate" their way out of a paper bag.

 

When I was a brand-new agent and I was asked how long I'd been "doing this", my stock answer was "longer than I care to admit" (true). 

 

If pressed, I would tell them: "While I may be new, I have the expertise of dozens of highly experienced agents at my back to draw upon, including my managing broker, whose ear I have whenever I need it, and if anything should come up that I don't have the answer to ... I will make sure to find out. 

 

No one will work harder for you than I will, because no one has more to prove for you, than I do. And especially since you are my only client, you get 100% of my time!"

I would disclose. Why? Should they find out from someone other than me, betrayal is the likely emotion.
So, I would do the 24/7/365 benefit of being my only client. "And besides, you are not really hiring me but the BROKERAGE. This brokerage ranks in the top 5 for market share so you can be sure this is not their first RODEO. Let me introduce you to my Broker."
Based on my perception of the suspect I may go the route of 
'Not your typical agent. These are all around you and you chose none of them perhaps because you wanted ideas that are fresh and modern. Someone you know will listen to YOU and not sweep you into the process."
And if I still feel insecure that is when I would come with the team. 
Be aware, when this meeting takes place the 'real' desire of the buyer or seller has been violated and this option was the default available. Their real desire and our union rules often do not play well together. "I hear you," is not a bad message to convey.

It was my number one fear when I started, being asked if I was new.  It took almost 10 years before anyone ever even asked me about my experience.  I would say no.  That is way too big a hurdle for a new agent to overcome.  Yes, they should have a mentor or friend that oversees all they do.  Of course, good training is a must as well.

My very first broker told me to say - I am a new agent but I've got the most experienced broker mentoring me every step of the way.  Nobody turned me down because I was new. I was new to real estate but not business.

Disclose? What does that mean? Would I lead by blurting out that I am new? Would I answer truthfully a question that might come up about my experience? Would I make my presentation with confidence and competence to make sure the question about my experience does not come up?

The subject has nothing to do with fiduciary duty unless the question comes up and the answer is a lie.

The agent is licensed by that state and therefor qualified to practice real estate... With that being said, I like to see a new agent shadow a well qualified Realtor for a few weeks to see best practices.

I am always amazed by those people who get licensed so that they can sell their own home without paying the full commission.

I just shake may head as I think about them hiring the most inept agent possible.

Last I checked the COE, there was nothing there to say it was a breach of fiduciary duties not to disclose one is new. When I first became newly licensed in NYC, I might not have yet sold a lot of NYC properties as an agent, but I knew NYC like the back of my hand, had personally bought and sold my own homes, had 20+ years of negotiating experience, etc. I would say I had quite a bit of experience and probably many better skills than agents who had some years in real estate under their belts. When I got my license in Charlotte, I brought all that to the table plus 6+ years as a top agent in NYC... so technically I was newly licensed, but a very experienced new licensee.

I was new to Real Estate Sales in 1999, but I already had bought, sold and invested in more real estate from 1989 - 1999 than almost any of my clients. I never had an issue saying I was newly licensed, because I was already a gunslinger in investing. Plus, rarely could they out talk me on strategy, numbers or negotiating. Oh, did I mention I had an ego that carried me beyond my years? LOL.

When you consider that ALL agents - at every stage of experience and seasoning - are STILL an extension of the managing/principal broker . . . probably not.
As a designated broker who once had more agents (thank God not for years now), new ones never went without me. Not for a while. So the client got 2 for 1. 
Biggest ticket purchase or sale of your life? You're gonna need someone who has your back. New agents need someone who has theirs.

When I was new, I told people my broker/owner/wife would also be helping and representing them and advising both me/them in any offer/sale.  And that she had 20+ years of experience (when I was new), she now has 30+ years.

No breach to be new to the industry. Newbies usually rely heavily on experienced agents or supervised very closely by their broker. We all started somewhere!

Last year, I helped a new agent on the other side of the transaction. The only way to get real life experience is to jump in because the classes do not teach that!

I don't believe it's a "disclosure" item, although the situation might become apparent. Just because they haven't done real estate doesn't mean they don't have experience in other fields that would make them competent newbies.

Thankfully, I also learned to leverage the experience of those around me and not try to do things on my own. It sounds so much better to work alongside an experienced agent and talk about your combined experience and sales volume.
