Landlords are people too and their rights need to be protected too. Landlords will need to work with those renters that are in arrears and not just wholesale evict them...only the scofflaws

It's the little guys that have been finally given a break. We've all heard stories of tenants taking advantage. Well, now they've got to pay their dues.

In my state, landlords can file for rent assistance & I'm not sure why they don't. Had a few property managers do it for their owners & it was no big deal. I think something is fishy if they complain but don't file for the assistance.

Maybe the owners are doing something unlawful & don't want to flag themselves.

I doubt it will make much difference, smart landlords were doing fine even with the moratorium, there were plenty of loopholes in it that made it tough for a tenant to qualify.

No government branch had the right to stop evictions.  Their responsibility is to help those that need help, not force one group of citizens to take on the responsibility to help another group.  What does it mean to have property rights if the government can just take them away with a stroke of the pen.  I hope the evictions truly do start again.  Judges can decide if the property owner is being fair or not.  There have been far too many that have abused this situation.

This decision will force us to find out whether there is going to be a flux of short sales or foreclosures.  This was inevitable and necessary.  Landlords benefit greatly as many have been on the ropes just barely hanging on.  Once again the scales were out of whack and common sense has prevailed.

Time will tell how judges will rule. Some will follow the law and some will follow whatever it is they follow. Eviction is not a fixed rule.

Without getting political, the SCOTUS ruling allowed states to create their own.  California looks set to keep their going for the foreseeable future, unless leadership changes next month.

 

Where landlord rights are respected, they will continue to have less risk than where they are not.  As always, the more you own the greater spread out your risk is.  One person gaming the system out of 100 properties is less impactful than out of one to two properties.  As with most things, it's the individual landlords trying to improve their life that get shafted and the mega corps that don't feel the pain.  Of course, the small landlord out here does have some eviction options that corps don't, so there is that.

Yes, I think it will help the cash flow resume for a % of landlords. I bet some new lease clauses will be created where tenants waive their rights to be protected by any eviction moratoriums. Whether it's enforcable or not, I don't know.

The costly wheels of justice turn slowly. Better tenant screening and interviews with previous landlords, more money to get in upfront... you won't need to evict, you won't have the property damage or need to use court house steps to evict. The neighbor in Unit 2B had a meth lab, or assaulted his girlfriend, etc. Other laws of the land in place that still move along the bad apples.

I know several who are in deep trouble and evictions might swiftly be followed by foreclosures which is very sad.  Their plans are to try to sell quickly before a foreclosure can happen, but only takes slightly more than 60 days in GA.  Banks seem to have zero compassion about rent not getting paid the last year +

Small landlords certainly deserve a break. Yet, lots of money has been set aside to help them but has remained undisbursed. This is not a simple issue.

California's eviction moratorium remains in place until at least Sept. 30th.
