No way here in IL. It's totally illegal. Ok, it's unenforceable too.

I remember something similar under a buy-back program from the board but never demanding use of a specific brokerage.

Yep. Not a new thing.
It mainly affects those owners who are leaving so they are not longer around to make a fuss.
The community supports the arrangement because the HOA benefits and the revenue keeps fees lower.
A seller CAN select another brokerage but the seller will still pay the fee.
Very much like what relocation companies do.

WOW! I don't think that would fly in my area, Wanda! 

I believe the real estate commission in your state would have a hay day with this. No one can dictate who the consumer can hire for a real estate transaction here. I would hope it's the same there!

My sense is that this cannot be done. You need to find the specific law that addresses the issue in your state.
