Kentucky's Agency Disclosure has 1. Transactions involving two agents in two brokerages, 2. Transactions involving two agents in the same office (then it defines whether it is designated agency or dual agency), 3. Involving only one agent (then defines if acting as a dual agent, or only representing one party), 4. involving non-client parties (then defines as transactional or non represent parties.)

When Florida came out with mandatory agency disclosures in 1994, the mega brokers did not like it. Up to that point the consumer was clueless...
Brokers now had to disclose who they really work for and were no longer able to just pretend or avoid the subject.
Dual Agency sounded too close to "double agent" so it became "transaction broker" because it sounded better.
The lie is that they allow the "transaction broker" to claim that they represent ( with NO FIDUCIARY DUTY) but then they changed the definition of represent to ONLY MEAN that the buyer or seller are not liable for anything the broker says or does.
Now they have totally done away with any agency disclosures....a great talking point for me that really does represent a buyer.

Florida thing. In Arizona we have disclosed dual agency, perfectly legal. You cannot represent 'no one' here. Are agency disclosure says you either represent the seller, you represent the buyer, or you may show buyer properties that you have listed but disclosure in writing must be made.

We have a choice to work with buyers as a Transaction Broker or Buyer Agent ONLY. They eliminated dual agency years ago.

South Carolina has a transaction agent option but I rarely see it and only did it myself once. Not an option in North Carolina. I seem to recall that New Jersey also has an option for transaction agency.
