I present what information I have. I haven't found my sellers not choosing an offer because of relaying some background information about prospective buyers, except in the case of veterans... I have found that many of my clients love being able to sell their home to a veteran if all other aspects of the offer are similar to other offers we receive. If I receive a "love" letter I ask my clients if they want to see it and explain the issues around them.

In commercial sales, the sellers do not really care who the buyers are!  However when it comes to leasing office or retail space, they do want to know about the companies and the retailers.  They want to be assured that the business is viable and they will be able to pay the monthly lease on time and last.  A

With the fair houng class I took for CEU, they mentioned these Buyer Love letters that can be an issue with all the "classes" of fair housing act  laws, so be careful. Some states have more classes than these basic 7. If one is appealing to  a seller to select a contract based by humanizing on one of these classes with a photo or reference in a letter it can be a violation.

 

The Fair Housing Act prohibits discrimination in housing based on the follow seven factors:

  1. Color
  2. Disability
  3. Familial status (i.e., having children under 18 in a household, including pregnant women) 
  4. National origin
  5. Race
  6. Religion
  7. Sex

Based upon the lengthy conversation I had with my risk management attorney regarding this subject matter, I would:

First, remind the seller of the conversation we had about receiving any personal information about the buyers. 

Ask if there is a change in their decision not to receive any.

If no change, then I proceed with the offers only. 

If there is a change, I would discuss again the recommendations of my risk management attorney. If the seller still wants to change,  I would document, amend the provision in the listing agreement that says no personal information,  have the seller sign it, then proceed to share the information. 

I am risk-averse.  I understand the subconscious as well as the conscious mind and how influence works with the brain. The slightest little thing about what is said could knowingly, or unknowingly, tip the seller's decision and that could be reasons that should not be considered.  

Price. Terms. Conditions. Financial Strenght/Qualifications of the Buyer.

I leave it up to the sellers. Most base their decision on the facts and math contained in the offer, not the potential buyers race, education, amount of kids, type of car they drive, etc. Here's just one example I've ran into after sellers declined to accept an offer from this family. They had sent me a photo of their family which was a white man married to black woman with 4 or 5 kids along with a bs letter. I never showed the letter or photo to the owners because neither were factors for the owners to consider when reviewing offers. A week later, my broker and the owners receive copies of the letter and photo in the mail claiming the owners and I discrimated against them and rejected their offer because they were a mixed raced family. Owners called their attorney, who called me and I told him that the owners never saw the photo or letter and I never mentioned it to them with offer. He advised owners to ignore it, and I relayed that info to my broker.

Love letters were deemed as a violation of Fair Housing, and are not allowed in Colorado.   Sellers are to accept an offer based on the offer, not who the buyers are.    The lender and I can show our ability to get the buyer to the closing table.

A letter detailing this info from a buyer is enough of a fair housing trap, having the agents get into this game just magnifies the problem.

I would stay far away from this.

I won a 7 Multiple Offer Battle at the End of 2020 . And it was clear that the “Love Letter” made all of the difference!!!

The Commonality that the Buyers had with the Seller’s and their Listing Agent made it near impossible , not to negotiate with my Buyers .

The letters I help compose is ALWAYS about the seller, not the buyer.
The seller makes it clear the  message that will bypass their RAS.
Agents should be paying attention to these invitations.
I feel the term 'love letters' is perjourative and minipulative.

The acr if selling for a seller is a business transation involving dollar and cents on a net in their pocket way. Agent verbally tells me something - I'm gonna pass it along with the caveat that 1. Agents will say anything so grain of salt and 2. Pay attention to the OFFER more weightily than anything else because of 1.

I've been given some tall tales verbally, then everyone gets amnesia. LOL

Present the damn offer, make it juicy and delicious and seller will hopefully bite!

Just because a selling agent asks me to convey the personal information about the buyer, I would not do so in a multiple offer situation.

Ultimately, we all need to recognize that the sellers have the ability to see the names of the buyers on the contracts.  If you think for one second that your sellers are not "googling" who is trying to buy their home, think again!  This is why I recommend to my sellers AND buyers, no social media about the houses that they are looking at or how many offers they have made.  It can affect their negotiating position.

I would say to the seller: "Their agents tell me that they are wonderful people. But, what would you expect? Now...let's figure out what kind of counter offer your want to make to separate these two worthy buyers. Or how would you like to make your decision?"

My daughter made an (personal) offer on a property (with multiple offers) where the listing agent REQUESTED a "why she wants to buy it letter"

 

I wrote it for her...it was total BS but she did get the property.
