There are agents everywhere who ignore any rules they see fit to ignore. Not all areas have no solicitation rules (I'm assuming for the pandemic). I've heard about some areas having this, but California is not under this restriction.

Our MLS strictly prohibits soliciting listings with a status of TOM. My sellers who have requested a change in status to TOM have been given a heads-up that agents may try to solicit their listing but any solicitation is both unethical and unprofessional. Would a seller really want to do business with an agent who violates the rules for their own gain?

Might be a good idea but then that goes against another COE about bad mouthig other agents.
I never thought about this but these agents are idiots. Of course, people took their house off the market if they wanted because they felt safer NOT that they weren't selling anymore.
In the 'old days' we used to take out all the description in the listing & put do not call in caps.

My experience was that it was new agents who don't know the rules or starving agents that don't know how to push their chair away from the computer and form real relationships Annette Lawrence , Palm Harbor, FL 727-420-4041 . It was never much of a problem here with the exception of one or two Brokers with no morals who would encourage that kind of behavior.

I only have one that is TOM and my sellers would tell me and oh it would be enforced, I'd file a complaint and my seller would take it up with the real estate commission as well.

It depends...I would handle it on a case by case basis depending on who the agent was and what, if any, relationship I had with them. If the agent did not comply, I would talk with the agent's broker and hope that would resolve the issue. Placing the guilty agent on a publicly viewable list would mean that you have stooped to their level so I would not. If it's a chronic offender, reporting to the association may be the only alternative...but again, case by case basis.

When one personally and knowingly makes a wrong decision guilt is born. There is no escape from this Universal Law. Ignoring or carrying on only compounds the guilt. No need to add to this as it also cuts you off from your sense, reasoning, intuition & God. A list of shame cannot compete with all that. Repentance and not repeating it frees one. However, the truth told will help it along. If you have something to say or do say or do it truthfully with charity. This may help bring someone to their senses. People who continue to ignore themselves and correction remain poor in spirit.

The "no solicitation" rule is enforced by our MLS - the fine is $5G's per incident and your name and your Designated Brokers name is posted - not to the general public but on a link on the front page of the MLS.

The status here (Tallahassee MLS) is Withdrawn. It's not the same as canceled; other agents have no right per NAR COE to contact that Seller.
If I am the Listing Agent, I would contact the offending agent. If they blow me off, I will report them to our Board Ethics or Grievance Committee.
