Eminent Domain has been around for 150 years, and there are rules on when it's supposed to be used. I've never been involved in the process so don't know if it's only used as specified. But, I'm not too concerned. Are you?

It's been in existence since I have been licensed and long before. I have never been involved in any eminent domain issues so far. No thoughts.

It's been in existence for well over a century.
I have never been involved in any ED cases to this point and living in a metropolitan area, am not really concerned with it...at least for now.

I've never given Eminent Domain two minutes of thought except when the subject was raised in real estate school.

Alexia and her husband Cecil owned a fiberglass fabrication shop for over 40 years in Clearwater FL. The adjacent St Pete College wanted their location for a parking lot.
They said.."Hmm, ok. But you need to help me find or exchange a property on which I can relocate my shop. No such real estate was found. So, the college exercised their influence on the city leaders and convinced the leader to exercise Eminent Domain to kick the owners out and bequeath the real estate to the college.
The problem with Eminent Domain is it violates property owner rights which is being eroded EVERY day. Remember last months question about compelling landlords to accept voucher, claiming refusal is discriminatory.

It has been used a lot in recent years in my area.

Eminent Domain will continue to exist when city, county or state government can make money off seizing land by claiming a greater need. A friend owned a thriving antiques business on the same property as her home. Both were leveled, along with several other homes to make room for a huge high end complex with businesses on the bottom floor and apartments on the other 3 floors.

It can swing both ways. I actually bought my apartment because Columbia University was expanding their campus nearby. Part of the 17 acres needed for the campus expansion used E.D. It was a rough area- and extremely underused. I mostly supported the E.D. but not entirely. Like it or not, it's here to stay. Without diving too deeply into the politics- I don't support using E.D. to build The Wall. I did like one senators suggestion to instead build out broadband in those areas instead- which serves the purpose of not only increasing access to poorly served communities, but can also used for more effective surveilance than The Wall could.

Eminent Domain as a way for govenments to take private land for public use has fallen into disfavor in many areas.

I have no thoughts on it.... does not apply to me now nor will it in the future....

Eminent Domain isn't necessarily a bad thing provided the Government is responsible and selective when using it. Then again, using "Government" and "responsible" in the same sentence is a bit of a leap.
