And what kind of drugs? Psych meds? Because I can think of quite a few who need to be ON them.

Seriously though, if you get any kind of a conviction for an offense like that, it has to be reported to the Department or you're unlicensed. And you may be required by the department to pay a fine or take classes or have a conditional license.

The big thing now is that marijuana is legal in a few states.

It might be advisable as part of the ActiveRain "initiation" process but too much confusion with even more government rigmarole that would likely lead to unintended consequences for licensing in the real estate field.

In NC we already have a background check done before licenses are issued. Not sure more needs be done. I don't know that I come across that many druggie real estate agents.

Actually, most work as employees of their broker.  For example, in California (more licensees than every state combined with the exception of New York), an agent with a "Salespersons" license is not allowed to sell on their own.  You need a Broker's license for that and you must be employed by a Broker.  There are even employment contracts put out by the state AOR.  Independent contractor status is only for taxation, insurance and payroll.

 

Now to answer the question, yes it should be.

I think background checks would be wise..... the license asks the question regarding felons.... and it's under penalty of perjury.... felons lie.... so a background check would be wise....MA does not have that....

No. I don't see many druggies in the biz. Over the past 20 years I've known of maybe 2 agents with a drug problem. Neither did any biz and left the biz within a year. Real estate is not the career choice of the drug user. Too much work needed to create a livalble income and the pay to play aspect keeps those that want to spend their pay on getting high rather than paying their bills and/or investing in their biz off the playing field.

Personally, I could care less but, I don't see it happening in a state that already has background checks as a requirement to even sit for the exam.
