In 16 years I've NEVER used an electronic document Andrew Cooper . I'm not even sure the State of North Dakota allows it.

I do know that when the State file nazi's show up they want paper copies and if I don't provide paper copies to cooperating brokers the poop hits the fan for the exact same reason (they have to show the file police a paper copy).

Almost exclusively. About the only document that I actually get a wet signature on is the Listing Agreement. That is because I am usually sitting at the table with the Seller and I don't want to let them get away.

In 2000 the state of California codified into Government Code section 16.5 that electronic signatures carried the same weight as "wet signatures."  It was in the Uniform Electronic Transaction Act (UETA).  (this actually came up in a discussion last night, so timely question!)

 

I use electronic signatures for the vast majority of my clients.  Some forms are best to be printed and done in person with some clients.  Whenever I show property or have a open house or go on a listing appointment, I always have a blank printed contract with me.  Nothing cools off a buyer/seller like having to wait for a contract to arrive in the email.  If they want to buy/list, we get it done right then and there.  AT MOST a 5 minute drive to the nearest coffee shop.
