Great question.  Daniel are you studying to be a Lawyer?  I remember learning a long time ago that a verbal contract was worth the paper it was written on! So, I only deal in written contracts/agreements. I don't know what would be a good example of an "implied contract" is but it would be interesting to know.

Implied is not in writing.  Seller says ... I want you to list my home.  You do not have a signed listing agreement.  That is implied and means nothing. Signatures carry a lot of weight in contracts! 

Implied contracts in our state (TN) don't work as the state law says they must be in writing to be valid.

Do not count on these verbal agreements in real estate.

A converstion at lunch with a prospect where you give them advice, it implies you are their agent and such implication has been found to be valid in Georgia courts.

If it is not in writing, it is not part of the contract. Differences of opinion, arguments, shouting fights and lawsuits can be the results of stuff that is "implied."

Really no such thing as an implied "contract"... if it's not in writing and not signed it doesn't exist as far as the law is concerned.
