To not screw them up. Article 26 of the Arizona Constitution does permit real estate licensees to prepare contracts incidental to a real estate transaction. In that respect we are unique compared to the rest of the country.

Depends on the state. In some states attorneys prepare them. Real estate agents do NOT prepare contracts... they are not attorneys. They fill in blanks on contracts.

For most deals you would send out a Contract Information Sheet to the Attorney with the Signed Offer to Purchase, Copy of the Deposit Check, signed Disclosures, Buyer's preapproval, the MLS Data Sheet & any other pertinent deal documents.
When it's a Short Sale of Foreclosure I'll usually be the one writing the Contract in which case I will use the State Sanctioned Real Estate Purchase Contract.

There is no one right answer to this question. It depends.
In some states, the agent only negotiates the main parts of the deal, ie; price, closing date, financing, etc. Then passes it to an attorney whose job it is to write the contract.
In other states, the agent may complete a pre-written contract.
However, I have seen many agents that think they are attorneys and write their own modifications or clauses to the contract. Most of the time, they do a poor job and the result is unpredictable at best.

Rachel Greene In my State, the agent fills in the blanks of a contract and can write Addendums/Amendments to the contract. It is important to be familar with each paragraph in the contract not to give legal advice, but to inform the client to what they may be signing.

my office uses the GBREB contracts and we fill in the blanks....however, every client we deal with must have an attorney...our rule... we don't wear that hat... and the seller's attorney will review our agreement and always adds his own attachments.... then the sellers' and buyers' attorneys communicate.... and finalize....

I prepare all my own Agreements of Purchase and Sale. I discuss with my client what conditions if any they would like to include, what closing date, what offer price, what they want in terms of appliances, etc., I review the offer with them to ensure they fully understand its contents. and they sign it.
