A 'transaction licensee" is someone who just shuffles the paperwork but does not advocate for either the buyer or seller. They are called "transaction brokers, facilitators, and non representatives".
The reason they are called "licensees" is because they are NOT an agent...the are simply a middle person. An agent is somone who actually represents a buyer or seller. A "licensee" offers no fiduciary duties.
In a typical buying and selling transaction, the consumer would actually be represented by an agent.
Many states are leaning toward "licensees" because they have less liability. Why? because they promised you nothing...
99.99 of licensees in Florida are "transaction brokers" who claim to represent...but the definition of represent is not to advocate. NO FIDUCIARY duties of loyalty, full confidentiality or full disclosure.
It is totally screwed up, but it helps dupe the consumer, so that you can pretend to represent the buyer and seller in the same transaction, and make more money.
