Don't get me started...
the ARM TWISTING that the builder uses to FORCE the buyer to use THEIR lender and THEIR title company...and the fees charged are higher.
Last month when a builder realized that buyer was already approved with his own lender and wanted to have his own attorney to do the title work, all hell broke loose.
Please note that BUYER is paying the title insurance. None the less, the builder removed the $7K in closing cost, removed all the appliances ( refrigerator, microwave, washer, dryer) removed all the window treatments and removed the auto garage door opener.

Right now the biggest struggle is builders too busy for their own good and making promises they don't want to keep or are two busy to make good on. We have recently been fighting a builder to complete very reasonable repair request items from a home inspection. The builder doesn't want to be bothered with these seemingly minor details, but it's a new construction home and the buyer is not unreasonable to want them done (things like the hot and cold water switched in faucets, the ceiling fan not being balanced, stuff like that). Builder doesn't care because he could probably sell it for more now than what it is contracted for since it's been several months in the build process. Not great PR though. Also, as agents we dislike the builder contracts and the builder requiring approval from preferred lenders and use of preferred title. We understand the reason for title but it's still not our favorite requirement when Title/Escrow is a buyer choice generally here. -Kasey

I have gone round and round with agents sitting in the models about this and SO wish that the state would come down on these builders for doing this. The worst ones are the ones that also OWN the mortgage company that they push on our buyers!

The item I have been most concerned about was a time in which the builder required our buyer to purchase the lot and provide them with a large amount of non refundable money before permits were ever pulled. We worked hard on this deal to make sure our buyer was protected and the (obviously) under financed builder didn't use our client's money to pay other creditors.
