PS:  who cares if a buyer who does not "value" you, is not happy?? they are in it strictly for the money and could care less if you are good or not.

In the past 20 years, I have had only one buyer ever ask...and the answer was a simple "no".  Quality clients just don't ask.

 My work, brain and skill has a value and that doesn't come for free. I would ask the buyer why this is a charity? In your market, like mine it is difficult to get a seller to accept your offer and to get to the keys. This buyer will ask for more at closing

It is illegal in Oregon to "kick back" commission to anyone.  Only licensed agents can receive commissions or referrals. Plus - you have earned your commission.  Why would you ever consider sharing this with someone else?

I very rarely pay for a lead from anyone for any reason and I certainly would never give up more than 10% of my commission. I'm a busy guy because people know they can count on me to do a good job for them. Give me the lead and you know your client/friend/relative will get great service. If that's not enough go ahead and sell your client/friend/relative to a lesser agent.

I'd tell the buyer, "50% is possible if you refer me 3 clients that want to buy or sell before we close escrow". Otherwise, a deal is a deal. I'd also say no if they are really that transactional, as I see no future in them beyond this commission...then Debe Maxwell, CRS has your best answer.

    In Florida, I as a Broker can rebate commission directly to a Buyer (or Seller).  I can charge or not charge whatever percentage or dollar amount we negotiate.

    But that is agreed to up front, in writing.  I won't renegotiate that after the fact.

I do not do rebates. In your case if in the contract, you honor it, if not in the contract, you have them read said contract. Worst case ask for half their pay for the next 3 months

Commission are negotiated up front.  If they know they are getting a rebate for 29% and you agreed to that, that is what stays. 

You are welcome to say no to further negotiation.  Just like, they could say know if you decided to renegotiate the 29%.

I would explain to the buyer that you have a buyer agency contract and also that you do not re-negotiate "after the fact".  I would use the analogy of employment.  If you get hired at $20/hour and you accept the job for that pay you don't come back to the boss "after the fact" and ask that they pay you $25/hour.  Just doesn't work that way.

This is a huge problem in our profession.  Why is it assumed or in some instances expected, that we will give up a portion of our pay to a buyer or seller?  I've never seen other licensed professions, i.e. doctors, lawyers, accountants practice this "madness".  My time and expertise is too vaulable.  I don't give rebates or commission cuts to clients.  Know your worth and stick to it.

I would respond. "Please write down your request and sign it."

Then,

I would remind the buyer they were presented that option at the very beginning with the understanding more would be required of them. 

I would remind them they turned that opportunity down.

After you eat the meal is not when you negotiate the cost. Of course that was the Presidents prime negotiating practice.

By the way, you are getting a good deal and there is a back up in place.

Shall we move forward?

Yes, I will let the deal fail for the 'difference' involved. And no, I will not defer that cost to the sellers side.

Now, what will I do with that submitted demand?
