Yes and it is SO frustrating!  I have begun to get right on the lenders - reminding them to request those documents the first day they get the file.  So far, that has worked for me.  (Knock on wood!)  

Not only are they tardy in getting the information but, they charge the buyers to complete them.  If they're charging for a service, they SHOULD be timely!

We handle that stuff here in IL under the attorneys review.  Contract also asks the seller if their was any discussion about dues increases, spec assessments on the horizon.

It's amazing how many agents never ask their sellers to find these before listing. It's different in an estate sale but these are regular sellers who should be able to produce them fairly quickly.

Contract says 7 days but there is no penalty for compliance.

Jeff lately this is the norm if you are the listing agent you better order it in advance.... so even if you or the seller have to pay for it... credit it back via Escrow... otherwise you are looking at delays to close...Endre

HOA are all different and some just drag their feet.  The seller is required to pay for the HOA documents here in Southern California now under new laws.  It is essential to get them order right away.

Our contract, following the DC statutes, give the management company 10 days from ratification to get the documents out.  And most, but not all, get them out a lost faster.

Yes Jeff, I wish all the HOA's used CondoCerts.com, but they do not. I have made it a practice to call ahead on to the HOA's on my listings and or buyers' contracts and get an e.t.a. from the Property Management company so I can set realistic expectations for both the buyers and the contingency removal expectations of the sellers.

Well, we usually order HOA docs the day we receive EMD in escrow. HOAs are charging here upfront fee( usually quite high: 500-700 per package). Usually we get it in 10-20 days.

No. We have an area in our MLS where the listing agent can upload these and other docs. If the date for receiving these documents is put in the contract correctly they will also come with the title commitment.

That has been and will likely continue to be an issue. I am very proactive. When I take a condo listing the HOA docs are included in the disclosures and inspection reports ALL of which are available the day the listing goes live on the MLS. I call that "best practice" Jeff Dowler

Yes, we have encountered difficulties with a few HOAs. Some of the folks in charge of these homeowners' associations have absolutely no respect for real estate agents/brokers and it seems many of them have no respect for state laws either.

No because the HOA has warned me not to insert less than 12 days in the contract to have them delivered to the buyer. I abide by that and expectations are set from the beginning and if they come in earlier it's a plus!

    If they are not delivered per Florida Statute, the deal will be dead.  Even so, I as a Buyer's Agent often have to step over the Listing Agent and get them myself (from the HOA or COA).

Yes, there were some delays, in prior years,. This year the HOA Addendum to the Purchase contract helps - it states what HOA documents will be received by the Buyer, as well as the HOA and the HOA Property management company phone and emails are on the Addendum. So the Buyer's agent can call if there are delays.

I usually remind both the escrow officer and the Buyer's agent to request the HOA disclosures as soon as we open escrow.

In Oregon we have a purchase agreement for condos and townhomes. This agreement has built into it a list of documents for the buyer to ask for which the seller must provide. It is a great tool to require seller disclosure on the property in a timely manner. If the seller doesn't provide the documents in the time frame dictated in the documents, then he/she is in breach of contract. But I have never seen this happen. The listing agent makes sure the documents are provided to the buyer for their full review and acceptance. The buyer can terminate the transaction if he/she is not satisfied with the information conveyed within the provided documents.
