There are strict laws regarding this. Google the information on NY state security deposit laws . Cll the local distrcit court for information.
Check with the local consumer protection agency.

If so it is best to get a lawyer sending a letter. The license will do virtually nothing....

The scary word in your question is "sublet". I don't know New York law, but in Florida that can be a precarious legal position to be in.
I hope your daughter gets her deposit back, I hope some New Yorkers answer the question for you.
I think some municipalities have their own regulators in addition to statewide regulators in NY.
