Unlicensed practice of law is taken very seriously in Florida so I recommend that all my clients ask their own real estate attorney. I do not ask my attorney and give them answers for liability reasons.

Even my attny clients ask me legal questions, best to be ready to point them in the right direction, but dont try to be a lawyer.

I do not give legal advise; however many agents do call me with questions about filling out contracts and addendum.

Hi Cody - They certainly do, and we're qualified to provide limited informaton on some questions, while we have to refer others to legal counsel. We use our client newsletter to inform them about what's happening.

First, the agents need to stay abreast of changes and updates either via CE, or better via current trade "rags".  I  inform customers of facts as they are known to me. If the matter is subject to legal interpretation or advice, I suggest reaching out to an attorney. In CT, attorneys close deals, so might as well engage one early in the process and start using him for advice, as needed.

Beyond answering questions about the actual blanks in the contract and what they mean I advise clients to seek the advice of attorney if they have legal questions.  As I am not an attorney and it's not legal for me to practice law.

No, that type of conversation never comes up. It's not a normal conversation for a buyer or seller in my market.

Cody, it is outside my scope of practice (and can get me in serious trouble) if I give legal advice without a law license.  Now with that said, I have no problem forwarding on an email from the state or the local association on a topic. 

For example the HUD "Thou shall rent to crooks" ruling.  If asked, I'll forward the link to the HUD page or an email from an official source describing the changes.  I will NOT help them interpret the regs.  I have two real estate attorneys I can refer out if they need an interpreation or have any "well what about X?" questions.

They know realtors are not the right place to ask. We place for sale signs. Fill in the blank spaces, order the reports, go to place.  

Any legal question I send them to our legal, CPA groups.
