There is no doubt for me. I would definitely disclosure. If you know about it and you don't disclosure, neighbors will enlighten new homeowners, and you might think of consequences. I disclosure everything that ''might affect the material value of the property''.

LOOOOONG before my real estate career I took a course on recognizing clandestine drug labs.  Meth labs were covered and the key take away that I will educate you on is that there are extremely toxic chemicals that are an airborne byproduct of the production process (and they also carry the red dye of the sudafed in the air).  Not only can you die within seconds of entering one of these facilities unprotected, but the TOXIC chemical seep into the walls, through the walls and into the studs and frame of the house.  The ONLY way to completely remediate this is to tear the house down and rebuild it from scratch... including the slab and foundation (in some cases).

 

I've seen picture where the wood inside the walls was cherry red from the airborne dye.

Would the buyer want to know?  Would the buyer be told by neighbors?  Would this stigmatize the home?  If you have to ask disclose.

Regardless of the law, it needs to be disclosed.

Don't kid yourself that remediation cures all the residual problems with living in a former meth house...it dosen't.  

As an Exclusive Buyers Agent  I would never recommend that my client buy one.

I think it should be disclosed whether it's required or not.... anything that would make a potential buyer change his/her mind about buying the property is disclosed by those who were on my team....in 38 years, I've never been sued, and I'm sure as hell not starting now....

At least in Minnesota it is required not only to disclose the meht part but also who did the cleanup and if it was cleared by authorities

I would disclose the fact. If the Buyer found out after inspections etc. it could get complicated if the buyer decided to back out.  Even if you win any dispute you still lose. Besides you never go wrong by doing the right thing. A buyer with small kids...how could you not let them know?

You have a moral duty to disclose it no matter the laws. How can we know that remediation really got rid of any after effects on the health of a child who might live there crawling on the floor?

Since most state law and virtually every jury favors the buyer, even if you weren’t required to disclose it I would. If you think disclosing it would impact the value or desirability of the property, the jury will think that times 10.

When sellers mention anything to me and ask if it should be disclosed I point out to the sellers disclosure and advice them to ask their attorney if they have doubts on how to fill it out.

THANKS EVERYONE for your answers and opinions. The laws regarding disclosure on houses that were used to manufacture meth differ state to state. In my opinion, the disclosure law should be consistent across the board nationwide due to the inherent danger of the toxicity that is produced when it is being cooked. Also, I think any agent should disclose up front to all buyer agents / potential buyers prior to getting a home under contract before wasting everyone's valuable time.
