I would not go to a company with this requirement. Establish your own database for long term success. You never know what changes will be needed.

I've never used company emails, CRM, etc.  Even when I was starting out, it didn't make sense to me.

The two big brokerages where I've worked had systems and made a big deal out of agents using them.  Protect your contacts.  Just say NO.

That sounds like what's YOURS is mine and what's mine is mine.  Just because of my jilted sense of fairness they'd have to get an admin to comb through my contracts and do the data entry.  They already have the data, do they just want you to do the data entry??

It'd be a mute point if they GAVE you the leads from their marketing efforts, at which point they already have the info.  If that's my blood, sweat and tears not sure that I would be very interested in just bending, I mean handing it over.    What is your contractual obligation? 

The Real Estate Brokerage would own the contact, if entered into their CRM. Additionally, it is the same is true for emails. If one of your contacts emails you on the company email system, they will try to make contact with the contact and take the contact for themselves. This is not true of all Real Estate Brokerages, but you should be aware of the possibilities. 

It's theirs unless specified by writing otherwise.

Depends what your Independent Contractor Agreement states.  Get it in writing!

I would say it is the brokerage's property. That is one reason I have my own website and don't use the brokers.

Depends on their policies and what you signed when joinging that brokerage. I would never add anything to what the brokerage own, they can always lock you out the second you change, or even doing a blog on the site they provide you with it benefits their SEO not yours. Always do everything on something you own within the digital world.

It's a good question to be answered before you sign with any brokerage. But if you imported your contact list into the broker's system, they will use the data. I'm not sure you'll be forbidden to use the data if you have a copy. Again, check before you sign with any broker.

It is theirs of course.  I wouldn't use their CRM nor would I use their email address they provide to you.

Russell - Just like all the contracts, the contact info for any client belongs to the brokerage, especially if it is in their CRM. They will have a history of all closed transactions anyway, so will have all that contact info whether you use their CRM or not.

Also, if they are handing you leads, then they will probably say those leads are theirs and not yours. If you are generating your own leads, then you need to ask them whether those are your own, or the brokerage considers it theirs. 

You need to know what your brokerage says about what happens to your contacts when you sever your relationship with them.

All listings, buyers and leads belong to the Broerage.  If you are allowed to take them with you if you leave should be stated in your contract.

Russell Alton This is a good question to ask the broker where you are thinking of going. Policies vary from company to company.

In Florida the broker owns all the contracts. 

It would probably go to the brokerage. I would negotiate to keep all my pre-exisitng contacts my own and keep them separate.
