There seems to be confusion here so let me explain. I was working with a buyer who made an offer on a house and found out the seller was another buyer who had an offer accepted by the seller and his contract was pending .

So when I called the MLS and asked is this even possible to list a home with someone other than the seller they responded by saying as long as the original seller gives permission this is allowed.

I don't understand how under any circumstances this should be allowed.

Jack - Not sure I understand your question, but we can place our listings in under contract but accepting backups status, as long as the seller has authorized that.

Do you mean live the property in an active status?????  NAR gives the Brokerage who hold s the listing the right to chose whether or not they want to pend it in the MLS.

In my mls ( Beverly HIlls, CA), the seller can use Backup status instead of Pending to market the property and accept backup offers.

no....not that I've ever heard of.... we have a contingent status and the property remains in the active state for backup offers...

If a buyer has an assignable contract, I could see where some States would allow buyer to list it for sale before going to settlement. If contract isn't assignable, I don't see how you can sell something that you don't actually own.

In our MLS a PID can have only 1 status.  Pick one, active, pending, pending with contingencies,withdrawn,expired,closed.
